Terms and Conditions

By booking your place at Swish you will be entering into a Contract with Swish Escape Limited (SEL) and these Terms and Conditions will form part of your contract. If for any reason you have to cancel your booking, cancellation charges will be incurred. In all cancellation circumstances the deposit payment is forfeited.

1. The Agreement
This contract is made between the Group Leader and SEL.

2. Group Leader
2.1 The person who makes the booking for Swish on behalf of each group of persons (or on behalf of themselves if travelling alone) will be the ‘Group Leader’. Where persons have agreed to share a room with other unknown persons then the responsibilities of being Group Leader are to be borne jointly and severally by all persons within that group.

2.2 The Group Leader must be over 18 years of age.

2.3 All correspondence will be sent to the Group Leader only and the Group Leader is responsible for ensuring that all persons travelling within his/her group are forwarded copies of all correspondence.

2.4 The Group Leader of each booking will be responsible for the total amount payable in respect of the whole group booked under their name and SEL will look to the Group Leader for payment of the total amount due under this contract.

2.5 SEL direct the Group Leader to pay all monies due under this contract directly to Potters Resort (Potters) who are acting as SEL’s agent in the collection of monies.

2.6 As group leader, it is your responsibility to draw your complete group’s attention to these terms and conditions and to ensure that they are observed.

2.7 On arrival it is the responsibility of the Group Leader to check that the room/rooms are clean and that there are no broken, damaged or missing items. Should there be any problems on arrival these should immediately be reported to the Potters reception team. 

2.8 Any damage or breakages within Potters resort during Swish are the sole responsibility of the Group Leader. The Group Leader is liable for the cost of repair or replacement of any damage or breakages.

2.9 Upon arrival at the resort the Group Leader will be given the ‘Swish Pack’. This will include a full programme of events at Swish and your accommodation keys.

2.10 By completing the online booking form you agree to SEL passing your personal details to Potters to allow Potters to finalise your booking for Swish.

2.11 Only the persons named within your group will be permitted access to Potters, therefore you must ensure that all the names on your parties booking are correct.

2.12 On arrival on site every guest will be given a gender specific wristband which must be worn throughout the duration of Swish.

3. Booking
3.1 By completing the Reservation Request Form online you are deemed to have accepted these terms and conditions in full and without any variation.

3.2 If you complete a Reservation Request Form online, your booking is not guaranteed, until Potters have processed and confirmed your booking and all deposits for your group have been paid. All rooms are sold on a first come first served basis and the website is kept as up to date as possible. Therefore we may return your booking form if your chosen accommodation is no longer available. Only written confirmation from Potters will confirm your place at Swish.

3.3 All payments are processed and held by Potters.

3.4 SEL reserve the right to amend the per person price if SEL and/or Potters are affected by governmental action including a change in the prevailing rate of VAT and the Group Leader will be notified of the amount of the increase in writing via post or e-mail.

3.5 All places are allocated on a full-board basis. ‘Wristband’ only for this event are not available. 

4. Deposits and Cancellation
4.1 A 20% deposit must be paid per person at the time of booking to secure your/your Group’s booking.

4.2 All deposits are non-refundable.

4.3 The balance of the total amount payable for each person/group at Swish is due to be paid on or before 29th December 2023.

4.4 If a booking is made after the date quoted in 4.3 then the full amount of your booking is due immediately.

4.5 If the full payment due is not received by the date quoted in 4.3 then we reserve the right to treat the reservation as cancelled and all deposits will be forfeited.

4.6 If a booking is cancelled after the date quoted in 4.3 then the full cost of your/your groups place at Swish is payable.

4.7 Once the full price for Swish has been paid, no refund can be given.

4.8 Written confirmation of each booking will be sent to you from Potters by post or email where appropriate. The confirmation received from Potters will inform you of the remaining balance payable. Please note that reminders will not be sent and it is your responsibility to ensure that your final balance payment is sent on time.

4.9 It may be necessary for us to cancel Swish before or after your booking is confirmed, please note that SEL will not pay any compensation for any losses incurred as a result of any such cancellation.

4.10 Please ensure that you take out your own travel insurance to cover any losses which you may incur in participating in Swish.

4.11 Cancellation of one place from a group booking is deemed cancellation of the whole booking and we cannot cancel single places from group bookings. For example, if a Quad Room for four people has been booked and one person from that booking cancels then your Quad room will be cancelled. Those persons who still wish to attend will need to re-book the correct accommodation for the remaining persons (subject to availability).

5. Gender
5.1 We will be attempting to keep an even gender balance between the number of men and women booked on to Swish. Because of this, from time to time the availability for certain genders will alter dependent upon the bookings at that time as we control any disparity that occurs.

5.2 You will be asked to confirm the number of men and women attending at the time of making your booking, please note that the gender specified at the time of booking can not be altered once your booking is confirmed and that on arrival at Swish gender coloured wristbands will be provided. If the gender of those persons on the booking do not match the persons who turn up on site, then all offending persons will be refused entry and all payments received in relation to the offending person/s booking forfeited.

6. Disclaimer
Dancing and other activities on this event are strenuous and/or aerobic activities and all attendees at Swish participate in all activities at their own risk. Neither SEL nor Potters can be held responsible for any loss or injury resulting from participation in any activities at Swish.

7. Complaints
If you wish to make a complaint regarding any aspect of Swish then you must notify SEL immediately by emailing dance@swishescape.com Most problems are capable of being remedied on the spot although if you remain unhappy with the action taken you must put any unresolved complaint in writing to SEL within 21 days of the end of Swish. We will then investigate the matter and contact you so that an amicable resolution can be reached if at all possible. We regret we cannot accept liability for any claim that is not notified to us in accordance with the above.

8. General
8.1 The Words ‘you’ and ‘Group Leader’ are used interchangeably and all references are to be interpreted accordingly.

8.2 SEL and Potters reserve the right to refuse to take any guest or booking, further, once your booking has been confirmed SEL and Potters reserve the right to cancel your booking, in the event that this occurs we will refund you the monies paid and our liability is strictly limited to that amount and we are not liable for any further amounts or compensation.

8.3 Both SEL and Potters have taken great care to ensure that our promotional material is correct at the time of publication although it is inevitable that some changes will need to be made. Potters Leisure Resort is open 52 weeks of the year and therefore pictures and descriptions are of a general nature and are used only to illustrate the quality and style of the Resort. Facilities, services and accommodations do vary for a variety of reasons including maintenance, renovation, adverse weather conditions and changing legislation and guidelines. Due to the above and similar reasons we reserve the right to make changes, add or withdraw facilities and services without prior notice and without making any refund/paying compensation for any inconvenience/losses caused.

8.4 The accommodation at Potters is only to be occupied by the persons named on your booking and visitors are not permitted to enter the Potters resort during Swish.

8.5 Photography, filming and/or recording by CEROC® officials: Your attendance constitutes your consent to such photography, filming and/or recording and to any use in and all media, or your appearance, voice and name for any purpose whatsoever in connection with any production proposed by Ceroc Enterprises Ltd. You understand that all photography, filming and/or recordings will be done in reliance on this consent given by you attending this event.

8.6 Please note that the Potters resort may need to be shared with other members of the public if the required level of sales for sole occupation by SEL guests are not met. In turn, this may necessitate changes to the programme of events previously advertised and we reserve our right to make such changes as and when required and without compensation or refunds being payable.

8.7 Parking of all vehicles is at your own risk and we will not accept liability for any damage however caused.

8.8 Personal items large and small left in the rooms or in the public areas remain your responsibility at all times.

8.9 Lost Property including goods left in the rooms are held by Potters for 28 days in Reception before being disposed of. We will at your request send items in the post for the cost of the postage plus a £5 packing and admin fee. All your goods remain your responsibility at all times and neither SEL nor Potters will be liable for any items of personal property whatsoever.

8.10 For health & safety reasons and to protect all guests, please be aware that Potters cannot accommodate anyone who has or has just had an infectious or contagious medical condition, without a doctor’s certificate to confirm that any such condition is no longer contagious.   You should inform SEL and Potters immediately should any such condition develop in any member of your party at any time within the 14 days prior to your arrival date.

8.11 Your booking will be accepted on the understanding that Norovirus and/or similar contagious bugs, which spread from person to person either directly or indirectly via surfaces, can be present in the general population at large and can affect any public space, are beyond our and Potters control.  You booking will be made on the understanding that Potters operates as one such public space and therefore cannot be immune to the potential Norovirus and/or similar bugs circulating amongst the general population.  Whilst SEL and Potters will do all they practically can to reduce such possibilities, neither SEL or Potters can be considered negligent or accept liability for damages howsoever caused, including illness, loss of employment or resulting costs, as a consequence of such public health risks that are introduced to Potters Resort.

8.12 If you are affected by such a condition, you must report the fact immediately to SEL and Potters in order for Potters to inform staff dealing with you and your accommodation.  If we or Potters staff suspect you are a risk or potentially contagious to other guests and staff, you will be confined to your room and your stay terminated immediately. 

8.13 This contract and all disputes and claims are governed by English Law and are subject to the exclusive jurisdiction of the Courts of England and Wales.
